The Presidential Election Petition tribunal sitting in Abuja, has on Wednesday, 15 March 2023 struck out two motions filed by the Peoples Democratic party and its presidential candidate, Atiku Abubakar, against the Independent National Electoral Commission President-elect, Bola Tinubu, and the All Progressives Congress.

The first motion (on notice) with the reference number CA/PEC/13m/2023 asked the court for permission to see INEC employees reconfigure the Bimodal Voter Accreditation System devices.

The second motion (exparte), which was submitted on March 14, asked the court for permission to serve Tinubu and APC with court papers via an alternative method, such as by serving them on members of their staff or pasting them up in their offices.

PDP’s counsel, Chief Ifeanyi Iboko at the hearing, said he filed a notice of discontinuance, thereby withdrawing those motions on the grounds that they had been overtaken by events.

As the court adjourned, Idoko stated to THE WHISTLER that the motion's goal was to watch INEC reconfigure the BVAS, but that because the court had already given the electoral umpire authority to proceed with reconfiguration, “we felt there was no need continue the motions.”

The 2023 presidential election is being challenged by Atiku and Peter Obi of the Labour Party.

According to INEC, access to the certified true copies of electoral materials has started to be given to parties who have been wronged.

The filing of petitions by the appropriate political parties will be the next step in this legal proceeding.
